The General Data Protection Regulation (GDPR)
The General Data Protection Regulation (GDPR) has been applicable since May 25, 2018. Its scope is broad, since it is sufficient to process the data of a person residing in the territory of the European Union to be subject to it.
The GDPR is a regulation that takes up the main existing principles of data protection, in particular the collection of consent from individuals, the legality of processing or even the retention periods to be respected.
This regulation offers an adequate protection of your customers’ or employees’ data. Although it may seem restrictive, it allows you to understand that the management of personal data is of paramount importance today.
The Federal Act on Data Protection (FADP)
On September 1, 2023, the new version of the FADP will come into force. It is more or less the same as the GDPR, but with some differences, especially regarding sanctions. Until that date, the provisions still in force will apply.
Currently, in order for a data collection to be lawful, certain principles must be respected, which are the same as those of the GDPR. On the other hand, the actors of the data processing are not clearly defined. There is also a relative lack of sanctions or even accountability in the event of a breach of the FADP.
This is why we prefer the application of the GPDR alone, as long as the new FADP has not come into force.
